1.Acceptance of Terms:
This is made and entered into this Agreement with Garment Mandi and you that you will be bound by the terms and conditions here of, which Garment Mandi in its discretion may additionally impose from time to time. The modified terms shall automatically be effective immediately after they are initially posted in our site. Your continued use of our services will signify your acceptance of the modified terms. If you do not agree to the modification, you must discontinue using the services.
2. Garment Mandi is Only an E-Platform for communicating Business Offers and Inquiries:
Our site acts as the Internet-based platform for users to locate prospective people to trade with. We are not involved in the actual transaction between trading partners. As a result, we have no control over the quality, safety, or legality of the items being traded, the truth or accuracy of the listed item, the ability of traders to fulfill their obligations in a trade agreement. We cannot and do not control whether or not traders will complete their part of a trade. In the case that there is any dispute between trading partners, Garment Mandi will be released from any claims, demands, and damages of every kind and nature arising out of or in any way connected to such disputes.
3. "As Is\" And \"As Available\" Basis of Service:
You acknowledge and agree that the services are provided on "as is" and "as available" basis. Garment Mandi assumes no responsibilities, implied or otherwise, for the timeliness, deletion, mis-delivery, or failure to store any user communications, personalization settings, or service subscriptions.
4. Registration Obligations:
When you register with us, you agree to: (1) supply true, accurate, current, and complete information about yourself and your company in the Garment Mandi registration form provided on our site, and (2) maintain and promptly update your registered information to keep it true, accurate, current, and complete. If you provide any information that is untrue, inaccurate, not current, or incomplete, Garment Mandi has the right to suspend or terminate your registration and refuse any current or future use of the services. If you have registered with us on behalf of a company or other entity, then you represent and warrant that you have the authority to bind such company or other entity to the terms.
5. Member's Username, Password, and Security:
During the registration process, you will create username and password. You are responsible for maintaining the confidentiality of your username and password, and for all activities occurring under your username and password. You agree to immediately alert Garment Mandi of any unauthorized use of your username and password or any other breach of security. You agree to ensure that you properly exit the web site at the end of each session. Garment Mandi cannot and will not be liable for any loss or damage arising from your failure to comply with these terms.
6. Your Information:
You agree that your information and the items you offer for trade on Garment Mandi -
will not be fraudulent or involve the sale of counterfeit or stolen items;
will not infringe any third party's copyright, patent, trademark, trade secret or other proprietary rights of publicity or privacy;
will not violate any law, statute, ordinance or regulation;
will not be defamatory, trade libelous, unlawfully threatening or unlawfully harassing;
will not be obscene or child pornography;
will not contain any viruses, or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information;
will not link directly or indirectly to, or include descriptions of goods or services that are prohibited under this agreement;
will not be in connection with chain letters, junk e-mail, spamming or any duplicative or unsolicited messages;
will not be used to collect e-mail addresses and other information about other without their consent; and to create false e-mail addresses or otherwise attempt to mislead others as to the identity of the sender or the origin of a message; and
will be of the sole responsibility of you. This means you, not Garment Mandi, are entirely responsible for all content (information, data, text, photographs, and/or graphics) you upload, post, e-mail, or otherwise transmit publicly or privately via our services.
Items listed are text descriptions, graphics, and/or pictures on Garment Mandi supplied by you that either describe an item you have and want to trade, or describe an item you are looking for. You may post either or both of these types of listings on Garment Mandi, if you place such offers in an appropriate category. Garment Mandi is not responsible for the accuracy or content of listings.
7. Privacy:
Garment Mandi's services are developed to appeal to audience worldwide. Please note that when you voluntarily disclose your information in Garment Mandi's trade center and directory, that information can be collected and used by Garment Mandi and others.
8. Advertising, Financial, and Logistics Services:
You agree that your dealings with or participation with any advertisers or members, whether it is for business or non-business, are solely between you and such parties. Garment Mandi should not be responsible or liable for any loss or damage of any sort incurred as the result of any dealings or as the result of the presence of such advertisers on our services.
9. External Links:
Our services provide, or third parties may provide, links to other web sites or resources. Since Garment Mandi has no control over such sites and resources, you agree that Garment Mandi is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible for any content, advertising, products, or other materials on or available from such sites or resources. You further agree that Garment Mandi shall not be responsible or liable directly or indirectly, for any damage or loss caused by or in connection with use of or reliance on any such content, goods or services on or through any such site or resource.
10. Termination:
You agree that Garment Mandi, in its sole discretion, may terminate your username, password, and postings, or remove and discard your information within our services, for any reason, if Garment Mandi believes that you have violated or acted inconsistently with the letter and spirit of the agreement.
11. Causes Beyond Control:
Garment Mandi shall not be liable to you for delays or failures in performing from causes beyond our reasonable control, including, but not limited to, acts of God, labor disputes or disturbances, material shortages or rationing, riots, acts of wars, governmental regulations, communication or utility failures, or casualties.
12. Agreement to terms of online payment:
When you or your company chooses any of the advertisement and promotion programs and services offered by Garment Mandi and use of the online credit card payment system for paying the subscription charges for the same, it implies to your agreement that your credit card account be debited with an equivalent amount of Indian currency as applicable and supplied by Garment Mandi on the day and date of transaction as per Indian Foreign Exchange rates issued by Reserve Bank of India.
All payments made by credit card or wire transfer/D.D/cheque for availing any service at Garment Mandi are non-refundable.
14. Payment Terms:
We as a merchant shall be under no liability whatsoever in respect of any loss or damage arising directly or indirectly out of the decline of authorization for any Transaction, on Account of the Cardholder having exceeded the preset limit mutually agreed by us with our acquiring bank from time to time.
